The father or other guardian remains responsible for the child&#8217;s affairs, guidance and education. As an exception, a custodian mother has educational guardianship in a way that serves the child&#8217;s interests. A dispute over education or another urgent interest may be presented to the competent summary-matters judge.<\/p>\n<h2>Conditions a custodian must meet<\/h2>\n<p>Article 113 requires capacity, the legal age, trustworthiness, the ability to raise and protect the child, supervision of education and freedom from infectious or dangerous disease. It also addresses convictions for sexual offences, addiction, religion and additional conditions depending on whether the custodian is a woman or a man. A mother&#8217;s remarriage does not produce an identical result in every case; the court assesses the child&#8217;s interests on the evidence and circumstances.<\/p>\n<h2>Who has priority after separation?<\/h2>\n<p>Under Article 114, custody is a right of the child and is shared by the parents while the marriage continues. After separation, the order is the mother, the father, the maternal grandmother and the paternal grandmother. The court then decides what best serves the child and may depart from that order when the child&#8217;s interests require it.<\/p>\n<h2>When can custody rights be lost?<\/h2>\n<p>Article 115 lists grounds including loss of a required condition, failure or inability to perform custody duties, relocation for residence in a way that defeats the child&#8217;s interests, or not claiming custody for more than one year after learning of the entitlement without an excuse, unless the child&#8217;s interests require otherwise. Depending on the case, written consent from the person specified by law or permission from the court may be required. Article 121 regulates visitation, taking the child for a visit and overnight contact. If the parents do not agree, the court decides an arrangement that serves the child&#8217;s interests, and its order may be enforced.<\/p>\n<h2>When can a child choose and when does custody end?<\/h2>\n<p>At age 15, Article 122 allows the child to choose to reside with either parent unless the child&#8217;s interests require otherwise. Under Article 123, custody ordinarily ends at age 18 Gregorian years, with continuation in the health circumstances specified by law. These rules differ materially from age limits repeated in older commentary based on the former 2005 law.<\/p>\n<h2>Custody for non-Muslim families<\/h2>\n<p>Some non-Muslim cases may fall under Federal Decree-Law No. 41 of 2022 on Civil Personal Status. That law adopts equal joint custody after divorce as a general rule, subject to the court&#8217;s power to adjust the arrangement according to the child&#8217;s interests and the parties&#8217; applications.
