Which laws regulate civil marriage?

Federal Decree-Law No. 41 of 2022 on Civil Personal Status regulates marriage, divorce, custody, inheritance and wills for people within its scope. Cabinet Resolution No. 122 of 2023 contains the Executive Regulation and procedural details. Abu Dhabi also has Law No. 14 of 2021 on Civil Marriage and its Effects, with Civil Family Court services available to residents and visitors subject to the applicable conditions.

Federal civil marriage conditions

Under the federal Executive Regulation, the principal conditions include:

  • Both the man and woman must be at least 21 Gregorian years old.
  • Each party must have the legal capacity required to enter the marriage.
  • The marriage must be between a man and a woman who expressly consent.
  • No prohibited family relationship may exist within the degrees specified by law.
  • The parties must satisfy the competent court’s identity and marital-status requirements.

The federal Civil Personal Status regime is principally directed to non-Muslims within its statutory scope. In some circumstances, options linked to nationality law or another permitted personal-status law may arise. The facts should therefore be reviewed before assuming that one route applies to every couple.

Civil marriage in Abu Dhabi

Abu Dhabi Judicial Department describes civil marriage as a civil contract registered before the court under Law No. 14 of 2021. The published service information states that both parties must be at least 18, must consent, must not be within a prohibited relationship and must not already be married. Muslim UAE citizens are excluded from that service. Routes are available for residents and visitors, with regular and express processing options subject to availability and current service conditions.

The difference between the federal published age requirement and the Abu Dhabi service requirement makes correct route selection essential.

Civil marriage in Dubai

The UAE Government portal states that Dubai’s civil marriage service is for non-Muslims, requires at least one party to be a Dubai resident and requires both parties to be at least 21. The parties must attend and provide original identification and proof of single status. Service channels, documents and charges can change, so the official service card should be checked at the time of filing.

Documents to review before filing

  • Passports, Emirates IDs and residence documents where applicable.
  • Evidence of current marital status and absence of another marriage.
  • A final divorce judgment or a former spouse’s death certificate where applicable.
  • Foreign-issued documents with the required attestations.

Are a guardian, medical test or witnesses required?

Civil marriage does not use the Sharia marriage requirements in the same manner, but the precise answer depends on the selected authority and legal route. Abu Dhabi’s current published information states that witnesses and a premarital medical certificate are not required for its service. The relevant service card should still be checked for any updated procedural requirement.
