UAE child custody lawyer for claims and enforcement
UAE child custody claims

A UAE child custody lawyer should identify the precise remedy before a case is filed: proof, removal or restoration of custody; visitation and overnight contact; permission to travel or a travel restriction; educational guardianship; delivery of passports; or enforcement of an existing judgment. Custody, maintenance and guardianship are related but legally distinct issues.

Abdulrahman Alaamri Advocates and Legal Consultants assists with custody matters in Dubai and across the UAE, from jurisdiction and applicable-law review through family guidance, settlement, litigation and enforcement.

Which custody application fits the dispute?

  • Proof of custody: when a formal judgment or certificate confirming custodian status is required.
  • Removal or transfer of custody: where a statutory condition is allegedly lost or the present arrangement conflicts with the child’s interests.
  • Restoration of custody: where the reason for losing custody has ceased.
  • Visitation and overnight contact: to set time, place and handover arrangements when the parents cannot agree.
  • Travel with the child: to seek court permission following refusal of consent or a justified protective travel measure.
  • Educational guardianship and documents: where education, passports or identification documents are disputed.
  • Enforcement: where a party refuses to comply with a custody or visitation order.

For the current statutory rules on priority, custodian conditions and age limits, read our UAE Child Custody Law guide.

Typical custody case process in Dubai and the UAE

  1. Confirm jurisdiction: review where the parties and child live and whether another case or judgment already exists.
  2. Identify the applicable law: nationality, religion and the civil or general personal-status regime can change the legal route.
  3. Family guidance or reconciliation: a dispute may be referred when appropriate, while urgent matters and cases in which reconciliation is not possible may follow a different route under the law.
  4. Prepare the claim and exhibits: state the facts, relief and legal basis and arrange certified legal translation and attestation of foreign documents when required.
  5. Consider interim relief: travel permission or restriction, interim maintenance and other protective measures depend on the facts and urgency.
  6. Judgment and enforcement: a separate enforcement file may be needed if visitation, handover or another obligation is not performed.

What does the court consider?

The child’s best interests are central. Relevant evidence may cover stable housing and education, practical caregiving ability, health and safety, the child’s relationship with each parent, compliance with visitation orders and the impact of relocation or travel. General allegations are rarely enough; material facts should be supported by documents or other admissible evidence.

Documents commonly reviewed

  • Marriage certificate, divorce certificate or judgment and any earlier case file.
  • Birth certificates, Emirates IDs, passports and the family book when applicable.
  • Evidence of housing, schooling, healthcare and child-related expenses.
  • Earlier custody, visitation or travel judgments and agreements.
  • Messages, official reports and evidence of non-compliance, where relevant.
  • Certified Arabic legal translations and attestations for foreign documents when required.

Custody, maintenance and guardianship are distinct

Custody concerns daily care and the child’s welfare. Maintenance concerns financial obligations. Guardianship covers the decisions and affairs specified by law. The matters may be raised together or through connected applications, but success on one issue does not automatically decide the others. The requested outcome should be defined for each issue.

Joint custody for non-Muslim families

The federal Civil Personal Status Law adopts equal joint custody after divorce as the general rule for people within its scope, subject to the court’s power to modify it or award sole custody when the child’s interests require it. Abu Dhabi Civil Family Court procedures may differ from other personal-status routes, so the appropriate court and law should be identified first.
